3.Notary Employee

The notary, who is an employee shall permit inspection and copying of the journal’s entries by a designated auditor or agent of the notary public’s employer, provided that:

1.1. The inspection and copying is done in the presence of the notary

2.2. The transactions are directly associated with the business purposes of the employer

The notary shall record the auditor’s or agent’s name and record the act of inspection and copying in the sequential journal.

1.A notary-employee shall provide copies of all line item entries that are directly associated with the employer’s business, but shall not be required to provide copies of any line-item entries that are not directly associated with the employer’s business

2.Confidentiality and safekeeping of any copies of the sequential journal given to the employer will be the responsibility of the employer and not the notary.

Exclusive Custody and Control

1. Failure of a notary to secure the journal or the official seal in a locked container or safe shall be cause to take administrative action against the notary public’s commission, which may include fines or suspension.

1.2. Notaries will not share or allow another notary to use the same sequential journal.

3. Notaries will not allow another notary or another person to share or use the same locked receptacle or safe.

4. 3.Notaries will not give the combination or another key to the locked receptacle to any other notary or any other person.

Willful failure to control seal.

A four-year statute of limitations is added to the misdemeanor crime of a notary public willfully failing to perform his or her required duties or failing to keep the notary public seal under his or her direct and exclusive control.
