How Does a Title Insurance Policy Protect Against These Dangers?

Answer:  If a claim is made against your title that is covered by your Title Insurance, Title Insurance protects you by:

1. Defending your title, in court if necessary, at our expense, as to covered matters.

2. Bearing the cost of settling the claim if it proves valid, in order to protect your title.

Answer:  Yes, the title insurance will protect the owner from anyone having a claim to their title to the property where the claim of title is based upon fraud.   A wrongful foreclosure would be included within this. You will want to make sure on the exceptions to title schedule that this is not excluded.

Author's Question:  What is the Statute of Limitations time limit for a Title Insurance claim regarding foreclosure? 

Answer:  Pursuant to Code of Civil Procedure §339(1), title insurance claims must be brought within two years from the time of "discovery of the loss or damage."

The author of this website mentions that he posted this section titled: FORECLOSURE NEWS on January 15, 2012.  This means most of you that didn't have prior knowledge of any property fraud prior to the date before you read this posted information may file a Title Insurance claim after January 15, 2012 and before statute of limitations expires in two years-which means your claim is legally valid regardless of the date of the wrongful foreclosure of the property.   

Everyone that had or has a home in foreclosure purchased

title insurance for their home.  You can file a claim at no cost.

Look through your records and

 

1.  Find  the name of the Title Insurance Company in your documents or ask the person or company who sold you the home-the person or company will help to identify the Title Insurance Company.

2.  After you have the name of the Title Insurance Company, GOOGLE search will find the name of the Title Company, address and phone number.

3.  Call and ask for a full copy of documents regarding your home emailed to you at no cost.

4.  Ask them for a claim form to fill out-don't fill it out just yet.

5.  GOOGLE search for the County Recorder's office in your county area.

6.  Look for the section that allows you to check for recorded documents under your name.

7.  Purchase all documents that involve your home "in" foreclosure or forclosed.

8.  Now fill out your Title Company claim form using the information you received.

9.  Mail the claim-Certified letter, Return Receipt to the Title Company.

 

You may decide to complete the claim with the following information; 

1.  "Agency that initially filed foreclosure failed to make the required showing that they were

 the legal holder of the Note, or Deed of Trust or Mortgage  at the time of foreclosure"

 

2.  Any additional information regarding fraudulent documents you discover.  You may

 include this statement, " Any and all additional documents not listed here and

submitted by the Agency filing foreclosure, is suspect of being fraudulent."

 

3. You may add:  Pursuant to Code of Civil Procedure §339(1), title insurance claims must be brought within two years from the discovery of the loss or damage.  I discovered this fraudulent foreclosure on; (Month-Day-Year)_________________________

 

4.  Finally, any additional information you may have to complete your claim. 

 

The Title Insurance Company may assign this claim to either a person(s) to investigate your claim.  Title Insurance Company will notify you of the time they require to process your claim.
