Power of Attorney

A Power of Attorney document must be signed by a principal which authorizes another person to sign documents for the principal.

Lets practice notarizing a California General Durable Power of Attorney Document and then certifying a copy of the Power of Attorney.

Steps to notarizing a document

  1. Check the document for completeness.

  2. 2.Read the document instructions for the Notary.

  3. 3.Check if the document needs an:

    [A]  Acknowledgment

    [B]  Jurat

    [C]  Subscribing Witness Loose Leaf  Certificate

4.4. Identify the signer of the document.

5.5. Determine competence and willingness by observing behavior. 

6. You may ask the following questions to determine competence and willingness:

1.  Is the document complete?

2.  Did you read and fully understand the document or did another person assist you with your understanding of the document?

3.  Are you being forced or coerced into signing the document?

4.  Are you signing the document of your own free will?

Remember,

 log into the sequential journal any questions you ask and the answers you receive from the document signer.

  1. 8.Record the act in the Sequential Journal.

  2. 9.Have the signer of the document sign the journal.

  3. 10.Have the signer of the document:

    [A] Sign the document

    [B] Date the document [If required]

  4. 11.The notary notarizes the document by stamping the official seal, then signs and dates the document or certificate that is attached to the document.

  5. 12.Request payment for services rendered if payment is required. 13.

  6. 13Check your work….

You probably scanned the document and opened your sequential journal to begin the registration of the information required. 

Here is  the Information to be registered in the Sequential Journal

1.       Insert today’s date as the date Mr. Bill Williams appeared before the notary to have this document notarized.

2.       Document date is May 21, 2007

3.       Bill Williams California Drivers License number is A0777455, Birth Date May 1, 1949, Expiration May 1, 2009.

4.       Current address is: 18090 Beach Blvd. Rm 5, Huntington Beach, Ca 92648

5.       You may register any question you find appropriate.

6.       You are charging $10.00 for the signature notarized.

 

Lets go over your entries in your journal;

1.     For the date of the notary service, you would have printed today’s date.

2.     For the Type of Notary Service; The document requires an acknowledgment service.

3.     For the Document date: you entered May 21, 2007.

4.     For the Type or Title of Document, you would have printed; California General Durable Power of Attorney. And, if you asked the signer; is the document complete, you would have Xed the box nearest the words; Signer stated document is complete. And you would have printed the amount of pages at the bottom of this box.

5.     In the Signer Identification box, you would have printed the initials; DMV or the words Department of Motor Vehicles.  The signer’s driver’s license number is A0777455, Birth Date May 1, 1949, Expiration May 1, 2009. You would have Xed the box nearest the words; Principal and Xed the box nearest the words; Satisfactory Evidence.

6.     In the Current Address box; you would have printed the signer’s address; 18090 Beach Blvd. Rm 5, Huntington Beach, Ca 92648.

7.     In the Additional Information box you would have noted that you asked the signer if the document was complete and the signer’s reply was yes. You may have asked additional questions pertaining to the document and registered both the question and the answer here. Take a quick look at the acknowledgment printed on the document.  You will agree with me that we are unable to complete the printed acknowledgment because new laws in 2008 require all notaries to use the new and State approved acknowledgment.  You will need to print information in the Additional Information box that you have attached an acknowledgment to the document. If you needed additional space to write additional information, you would have Xed the box nearest the words; Additional information continued on page____; and noted the page number in the back of the journal.

8.     In the Signature box you would have printed the signer’s name and had the signer sign the legal signature.

9.     In the Fee box you would have noted that you charged a fee of $10.00 for one signature notarized and placed the words “No Charge” or NC in the traveling fee and tips box.

10.        In the Thumbprint box you would have left it blank or printed the words, “ Not Required.”

After you have completed the entries in your journal you would begin to notarize the document.

 

The following Information for the document may be useful.

1.       Signature of Agent will be signed by the escrow agent after they receive the document from the document signer.

2.       In the venue, just above the printed acknowledgement you would Insert the county you are standing in when you notarized the document.

3.       You would have inserted today’s date as the date Mr. Bill Williams appeared before the notary to have this document notarized.

4.       You would have inserted your printed name and added the words notary public.

5.       You would have lined out everything that did not apply to this document or the document signer.

6.       You would have completed the notary service by stamping your notary seal near the signature line and signed your name to the document with the words Notary Public after your name.

 

You do not need to involve yourself with the “Acknowledgement of Agent” or the “Preparation Statement” just below your seal and signature.

 

 

The Notary can certify a copy of an original Power of Attorney by: 

1.

1.  Register information in a line item entry in the sequential journal pertaining to certifying a copy of a Power of Attorney .

2.  Copy the notarized original power of attorney.

3.  Attach a Certified Copy of a Power of Attorney loose leaf certificate to the copy of the original.

4.  You may charge the signer $10.00 for the one certified copy you have prepared.
