Subscribing and one Credible Witness

 

  1. A subscribing witness is a witness to the signing of a document by a principal document signer who cannot appear in front of a notary.

  2. A Credible Witness is a person who verifies the identity of the subscribing witness and is personally known to the notary.

 

 

The subscribing witness must be personally known to the notary

    “OR”

ŘThe subscribing witness’s identity must be proved to the notary by a credible witness who is personally known to the notary.

To Qualify one Credible Witness

The notary must give the credible witness the oath and ask the following question:

 

Do you personally know the subscribing witness?

 

 

To Qualify the Subscribing Witness

The notary gives the oath to the subscribing witness and asks:

 

l1.  Do you personally know the principal?

2.  Did you witness the principal sign the document or did the principal acknowledge signing the document?

3.  Did the principal ask you to sign the document as a subscribing witness?
