SUBSCRIBING WITNESS
 
A subscribing witness

is a witness to the signing of a document by a principal document signer who cannot appear in front of a notary.

 

A SUBSCRIBING WITNESS IS A PERSON WHO:

 

1.  Personally knows the principal document signer.

2.  Sees a document signed by the principal, or the principal acknowledges signing the document.

3.  At the request of the principal, the subscribing witness signs the document as a subscribing witness.

4.  The subscribing witness takes the document to a notary who personally knows the subscribing witness, to have the document notarized.

5.  The subscribing witness represents the principle document signer when the document is being notarized.

The notary gives the oath to the subscribing witness and asks:

1.  Do you personally know the principal document signer?

2.  Did you witness the principal sign the document or did the principal acknowledge signing the document?

3.   Did the principal ask you to take the document to the notary and have the document notarized?
