The identity of the principal

For an Acknowledgment Notary Service

 

Ø1.  May no longer be established by personal knowledge of the notary.

Ø2.  Must be established by satisfactory evidence only.

Ø3.  A principal, requiring one credible witness to verify his/her identify must be personally known to the notary public and prove their identity by satisfactory evidence.

Ø4.  A notary who willfully states as true any material fact known to be false can be subject to a civil penalty of up to $10,000.  ( Civil Code 1189)

5.  Violation of the section subjects a notary public to a civil penalty of up to $10,000 in an administrative action brought by the Secretary of State or a public prosecutor.
