Signature by Mark

 

 
If a principal cannot sign his/her name, the principal may sign the document by mark in the presence of two witnesses. 
 
Requirements for signature by mark are:
1.

1.  The principal must be identified by the notary by either personal knowledge or satisfactory evidence

 

2.2.  The principal must sign the document by placing his/her mark on the signature line of the document

 

3.3.  One witness must sign the principal’s name next to the principal’s mark.

 

4.4.  Both witnesses must sign their names to the document as witnesses.

 

5.The notary is not required to identify the two witnesses who witnessed the signing by mark, or to have the two witnesses sign the sequential journal.
