Sequential Journal

 

 
The notary shall not surrender the sequential journal to any person, except:
 

1.1.  The County clerk, or

2.2.  A peace officer

acting in an official capacity in response to a criminal search warrant or court order signed by a judge and served on the notary.

 

The notary shall obtain a receipt for the sequential  journal and shall:

1.  notify the Secretary of State by certified mail within 10 days that the journal was relinquished to a peace officer. 

2.  The notary public may obtain a new sequential journal.   

3.  If the sequential journal relinquished to a peace officer is returned to the notary and a new journal has been obtained,  The notary shall make no new entries in the returned sequential journal. 

1.4.  The peace officer who seizes a journal must notify the Secretary of State within 24 hours or as soon as possible of the name of the notary public whose journal was seized.

2.5.  In addition to the Secretary of State, a peace officer, acting within his or her authority may also examine the notary public’s pertinent records.

3.6.  The notary must notify the Secretary of State by certified mail within 10 days.  (Gov. Code 8206 (d))

The notary shall receive a receipt for the sequential  journal.
